Terminal Services
The terminal services described on the service pages are subject to this framework of terms and to any additional booking or service agreement you sign with us. Where a service agreement exists between us, the specific terms of that agreement take precedence over these general terms in relation to that service.
Container loading and unloading. We provide shore cranes, operators and the sequencing needed to work a vessel safely and efficiently.
Vessel berth scheduling. We plan berth windows and crane allocation based on the vessel particulars you give us, and we keep you informed of any change.
Yard planning and stacking. We assign each container to a slot in our stacking plan so that cargo can be retrieved quickly and moves are kept short.
Gate and truck operations. We handle the inbound and outbound flows at the gate and aim for a swift truck turnaround.
Reefer and special cargo. We provide monitored power points for reefers and a coordinated lane for dangerous, project and out-of-gauge cargo.
Community systems. We exchange data with ports, shipping lines and customs through secure electronic channels.
Every service is performed in accordance with applicable law, port rules and safety standards. We reserve the right to decline a service where safety, security or legal compliance requires it.
Bookings and Confirmations
A booking becomes binding only when we confirm it in writing, by email, through our systems or in a signed agreement. An expression of interest, a phone conversation or an implied intention does not, on its own, create a confirmed booking.
When you request a berth window, reefer slot or gate capacity, you must provide the vessel name, arrival time, draft, cargo volume and any special handling requirements. If you provide incomplete or late information, we may be unable to hold a window and our agreed service levels may not apply.
We may need to adjust a confirmed window where an operational event, a port instruction or a safety matter makes it necessary. We will tell you as soon as we reasonably can and try to limit the impact on your schedule.
Fees and Payment
Fees for terminal services are set out in the applicable tariff, rate card or service agreement in place at the time of booking. You agree to pay all sums that become due in respect of confirmed services, at the time and in the manner set out in the agreement.
Unless stated otherwise, all fees are exclusive of applicable taxes, duties and government charges, which you will also pay. Late payment may attract interest and may lead us to hold or suspend services until the account is brought up to date.
A dispute over a charge does not suspend your responsibility to pay the undisputed portion on time. We will review any genuine dispute promptly and refund amounts we agree are wrong.
Your Obligations
In exchange for our services, you agree to meet a set of clear obligations. They exist to keep the terminal safe and to make sure the plan stays honest.
You will provide accurate cargo, vessel and contact information in good time. You will ensure that anyone entering the terminal on your behalf obeys our safety rules, wears the correct personal protective equipment and follows the directions of our staff.
You will not submit free-text content that is unlawful, offensive, defamatory or misleading, and you will not use the website to transmit viruses or malicious software. You will comply with all applicable laws, including customs, security, dangerous goods and environmental regulations.
Where you rely on third parties such as hauliers or agents, you remain responsible for the correctness of the instructions they give us on your behalf.
Intellectual Property
The design, text, graphics, layout and software of the HutchPort website are protected by copyright and other intellectual property rights. They belong to Hutchison Ports Indonesia Limited or to the parties who have licensed them to us.

Where liability is not excluded, our total liability for a claim arising from the website itself will be limited to the amount you have paid us for the relevant service, or one hundred US dollars, whichever is lower.
Indemnity
You agree to indemnify and hold harmless the Company and its officers, employees and agents from and against any claims, damages, losses, liabilities and reasonable expenses that arise out of your breach of these terms, your misuse of the website, or your breach of any law or of the rights of a third party.
This indemnity extends to claims made by hauliers, agents, customs and other parties whom you involve in the use of our terminal services. You remain responsible for the acts and omissions of those you appoint.
We will give you prompt notice of any claim covered by this indemnity, cooperate in its defence and allow you to conduct the defence with counsel of your choosing, provided that you do not settle a claim in a way that admits liability on our part without our written consent.
Termination
We may suspend or terminate your access to the website at any time, with or without notice, where your use breaches these terms, where the law requires it, or where we are changing or closing the website. Termination of website access does not automatically end an existing commercial service agreement.
You may stop using the website at any time. Provisions of these terms that are intended to survive, such as those covering intellectual property, limitation of liability, indemnity and governing law, will continue to apply after the relationship ends.
